If you are thinking about formally ending your relationship, it may help to seek legal advice as early as possible in the process to ensure that your rights are protected. It can be a challenging time, but we can offer expert guidance as you make informed decisions about you and your family’s future, and the implications of any important decisions during this time.

In this country, there is only one ground for divorce – the irretrievable breakdown of the marriage, which must be based on one of five facts set out in the Matrimonial Causes Act 1973. The person petitioning for divorce has to rely on one of them –

  • Adultery (of the other spouse)
  • Unreasonable behaviour
  • Separation for two years or more (where the other consents)
  • Separation for five years or more (no consent from the other needed)
  • Desertion (rarely used)

You cannot bring divorce proceedings until you have been married for at least 12 months. It is possible, however, to have the marriage annulled or obtain a decree of judicial separation.

No fault divorce is set to become law in the UK later in 2019. It is hoped that this will remove the damaging ‘blame game.’

What people say...

The team at Clarity Law represented me and I can honestly say that I do not know what I would have done without them. They helped me to stay focused on the bigger picture and I am grateful to them for helping me achieve the best possible outcome.

From the moment I met Ann I knew I was in safe hands, and the advice, support and guidance she gave me over the following 2 years was outstanding. Ann doesn’t waste your money by ‘holding your hand’, she really does get down to business and most certainly ‘knows her stuff’.

For me as a returning client to Clarity Family Law, the service provided by Ann and the team was first class.

PS

I instructed Clarity Family Law as a result of a personal recommendation after my initial solicitors provided me with a very poor service. I have been very happy and cannot fault their service in any way! Thank you so much.
